RGNUL- SAM Conclave on Emerging Trends in Insolvency and Bankruptcy Laws, 2024

RGNUL Financial and Mercantile Law Review in collaboration with Shardul Amarchand Mangaldas & Co., proudly hosted the 4th RGNUL-SAM Conclave Expert panel Discussion on November 9th 2024. This year’s conclave showcased a remarkable standard of discussion and thought leadership on 𝐄𝐦𝐞𝐫𝐠𝐢𝐧𝐠 𝐓𝐫𝐞𝐧𝐝𝐬 𝐢𝐧 𝐈𝐧𝐬𝐨𝐥𝐯𝐞𝐧𝐜𝐲 𝐚𝐧𝐝 𝐁𝐚𝐧𝐤𝐫𝐮𝐩𝐭𝐜𝐲 𝐋𝐚𝐰𝐬.

The Event:

 

The Conclave opened with the Expert Panel Discussion led by distinguished experts, including Mr. Saurav Panda, Mr. Vaijayant Paliwal, Mr. Sagar Dhawan, Mr. Pratik Datta, and Mr. Navneet Gupta. Together, they shared invaluable perspectives on the evolving challenges and innovations in the field of insolvency and bankruptcy law in India, offering insights grounded in both practice and policy. The Expert Panel Discussion provided an enriching environment for knowledge exchange between legal practitioners, academics, and students, highlighting the critical importance of dialogue in understanding and shaping insolvency and bankruptcy law in India.The second day marked the paper presentations along with the valedictory ceremony.

Paper Presentation:

 

For the Paper Presentation, the Editorial Board had invited submissions from law students, academicians, working professionals, and research scholars aimed at contributing to the discourse around the emerging trends and practical issues in banking and finance in India, through an exhaustive list of sub-themes. Research proposals were also allowed to be submitted by individuals interested in writing on issues beyond the given sub-themes but falling within the ambit of the larger debate. Entries were then shortlisted, and the authors were invited to present their research to our panel of experts who judged these entries.

 

Among all the papers presented during the Paper Presentation Session on 10th November, the first position was secured by Ms. Kim Korwani, a 4th year student from Institute of Law, Nirma University for her Article on the topic “Supporting Guarantees and Corporate Insolvencies: IBBI’s Proposed Overhaul and a Comparative Exploration of Global Insolvency Paradigms”. Whereas, the 1st Runners up rank was bagged by Mr. Souhardya Roy and Mr. Vishal Myneni, 3rd year students from West Bengal National University Of Juridical Sciences, for their Article on the topic “Reimagining the IBC: Prioritising Environmental Claims in India’s Corporate Insolvency and Bankruptcy Framework”.Finally, the 2nd Runners up were Mr. Yash Arjariya and Mr. Aishwarya Tiwari, 4th year students from Hidayatullah National Law University for their Article on the topic “Navigating Crypto Exchange Bankruptcies: Practical Guide to Asset Segregation and Valuation”.

Among all the papers presented in the Conclave, the top three have been awarded Certificates of Merit. The authors of the top entry have been rewarded with an internship opportunity at SAM & Co, along with a cash prize. Additionally, after a comprehensive review of the papers shortlisted for presentation, the Editorial Board will be publishing a compilation of the best entries.

The 4th RGNUL-SAM Conclave commenced with an enlightening Expert Panel Discussion, featuring an illustrious lineup of distinguished speakers who are pioneers in the field of insolvency and bankruptcy law.

The session underscored the critical role of collaborative dialogue in navigating the complexities of insolvency and bankruptcy laws and highlighted the interplay of practice, policy, and academia in shaping this ever-evolving field.
